Commonwealth citizens with at least one
grandparent who was born in the United Kingdom are treated very favorably under
the Immigration Rules. Once they have reached the age of 17, they may come to
the United Kingdom for up to four years to seek and take employment. At the end
of the four-year period they are routinely granted settlement so long as the
stay has been continuous.
The rules do require that the applicant has sufficient means to maintain and
accommodate both him or herself and any dependants. There is no recourse to
public funds available. The applicant may need to show evidence of potential
employment that will meet these needs. Some Entry Clearance Officers are
requiring evidence of accommodation also, as this cost can be substantial for a
whole family. The spouse of the applicant may also work.
It is worth noting that the relevant grandparent must have been born in the
United Kingdom or Islands. The fact that the grandparent was a British passport
holder is not sufficient for this category.
