Immigration Rules allows overseas companies to dispatch an individual to the
United Kingdom for business purposes. It is used mainly by representatives or
managers of overseas companies to establish a branch or subsidiary in the
United Kingdom.
The provision is designed to benefit business and trade. The authorities are
vigilant in ensuring that it is used for this purpose and not for the
immigration convenience of the individual. With this in mind, applications from
a member of a family firm are closely scrutinised. This is to ensure that the
applicant is suitably qualified to represent the business and will have true
operational control of the subsidiary.
There is a shareholding limit to ensure that the business remains centred
overseas rather than a major shareholder moving the core of the business to the
United Kingdom.
Separate provision is made for individuals establishing new businesses in the
United Kingdom. (see Establishing a business)
A sole representatives may represent one company only and must be a full-time
employee of the company. This precludes individuals who would otherwise be
commissioned selling agents.
