Employers need to establish the work permit that is most appropriate to their needs. The main types are:
  • Business and commercial - These are general permits for employees required for short or long-term employment to meet business needs
  • Sports people and entertainers (stangely this includes fashion models)
  • Training and work experience (TWES)
  • Sector based schemes (SBS) - We do not currently assist with these types of permit
There are exceptions but for business and commercial permits the employer will normally need to show that genuine efforts have been made to fill a vacancy from the resident labour force.
The resident labour force is considered to be EEA nationals or non-EEA nationals who are otherwise permitted to work in the United Kingdom (e.g. Commonwealth citizens with United Kingdom ancestry who have leave to enter or remain in the United Kingdom without restriction on taking employment). The usual way of showing that genuine efforts have been made to employ a resident worker is by proving that the vacancy has been advertised in the most appropriate medium. This may be a national newspaper, a specialist trade journal or, in certain circumstances, internet advertising.
